Terms of Use — Draskan

These Terms of Use (“Terms”) are a contract between you and MACRODARK LLC (“MacroDark,” “we,” “us”) for Draskan, our iPhone app for creators, including versions distributed as a TestFlight beta, and for the related web subscription.
Draskan is an alternate product of MACRODARK LLC. It is not the MacroDark CMS. The Terms of Service at macrodark.com apply to that Service, not to Draskan. These Terms control for Draskan. If a translation of these Terms is posted, the English version controls.
By tapping “I agree,” checking a box that says you agree, creating or paying for a Draskan subscription, or using Draskan, you agree to these Terms and to the Draskan Privacy Policy posted with them.
1. Eligibility
You must be 18 or older. Draskan is not offered to residents of the European Union, the European Economic Area, Switzerland, or the United Kingdom. Draskan is not offered in Cuba, Iran, North Korea, or Syria, or to anyone with whom U.S. law forbids us to deal. You represent, each time you use Draskan and each time you pay, that you meet these rules and that the information you give us is true.
2. The app
Draskan helps you prepare posts and publish them to X using your own X credentials. Your keys stay on your iPhone. You review each post. Publishing is never automatic. Nothing is sent to X until you tap Publish. That tap is your deliberate action.
Draskan is built for creators, not for spam. The app requires a waiting period between posts and includes daily and monthly limits, which you can see and adjust in the app.
Your first 500 posts are free. After that, create and publish stay locked until you have an active paid subscription.
You need your own X account and your own X API keys. The app requires you to have X Premium (Basic or Plus). We do not sell X Premium. Your relationship with X is yours. You must follow X’s terms and rules. MacroDark is not affiliated with or endorsed by X Corp. or its affiliates.
3. Grok and xAI
MacroDark is not affiliated with or endorsed by xAI. “Grok” and related marks belong to their owners. Draskan does not provide the Grok service and does not use those marks as our own product name.
If you use Grok, Grok Bot, Grok Build, or other xAI tools, you do so with your own accounts and under those providers’ terms. If you place draft files into folders on your iPhone, those files stay on the device and are not sent to MacroDark.
4. Price, renewal, and how to cancel
The paid plan is $4.20 USD per month. It is paid on MacroDark’s website, not through Apple In-App Purchase. Apple is not a party to the subscription and is not responsible for it.
The subscription renews automatically every month until you cancel. By subscribing you agree that we may charge the payment method you use (or that our processor has on file) the then-current monthly price at each renewal, until you cancel. If the price will change, we will tell you in advance as the law requires.
You may cancel at any time, online, on the MacroDark website where you started or manage your Draskan subscription, before the next renewal. You do not have to call us or send mail to cancel. Cancellation stops the next charge. You keep access until the end of the monthly period you already paid for.
The $4.20 monthly price, the fact that the plan renews until you cancel, and how to cancel are also shown to you before you pay.
If a tax must be collected, it will be shown before you pay. We do not add a surcharge for paying with a credit card.
5. No refunds
No refunds. This is the only refund clause in these Terms. It covers Draskan and the Draskan subscription.
All sales are final. Once a monthly period has started, that period is not refundable or prorated, in whole or in part, because of unused time or unused posts, or because you closed the app, deleted the app, were unhappy with a post or with X, or moved to other software.
Cancelling stops the next charge. You keep access until the end of the period you paid for.
A chargeback or payment dispute is not a refund. It does not change these rules, and a chargeback without a good-faith dispute is a breach of these Terms.
We make no money-back promise of any kind.
The only exceptions. We refund a charge, or the affected part of it, only when: (a) you were under 18 when the charge was made, to the extent the law of your state requires; (b) the charge resulted from our fraud or our error; (c) the charge was unauthorized or a duplicate, including a charge made after a cancellation we received before the renewal; (d) Draskan or the paid subscription you paid for never ran or was never made available to you; or (e) the law requires a refund.
6. Your content and your keys
You are responsible for your keys, your posts, your media, and what you publish to X. You promise you have the rights to publish what you publish, and that it does not violate the law or X’s rules.
You grant us only the limited permission we need to operate billing and subscription checks. We do not need, and we do not take, a license to publish your posts ourselves.
Keep your keys secret. Anyone with your keys can act as you on X.
7. Acceptable use
You may not use Draskan to spam, to evade X’s rules, to break the law, to infringe other people’s rights, to attack or overload any system, or to try to reach our billing or other systems except as the app and website allow. We may suspend or end access if you do.
8. Privacy
The Draskan Privacy Policy explains what we do with personal information. It is part of this contract.
9. “As is” and our responsibility
To the maximum extent the law allows, Draskan is provided “as is.” We do not promise that it will be uninterrupted, error-free, or available at any particular time, or that a post will look a certain way on X.
Nothing in these Terms limits rights you have that cannot be waived, including rights against us for our fraud.
To the maximum extent the law allows, MACRODARK LLC is not liable for lost posts, lost keys, lost profits, or indirect or consequential damages, or for anything that happens on X after you tap Publish. Our total liability for claims arising out of Draskan is limited to the amount you paid us for Draskan in the three months before the claim. These limits do not apply where the law does not allow them.
10. Changes
We may update these Terms. We will post the updated Terms at this URL and update the effective date. If you keep using Draskan or keep paying after the change takes effect, you agree to the new Terms, except where the law requires a different method of agreement. If you do not agree, cancel and stop using Draskan.
11. Distribution through Apple
If you download Draskan from TestFlight or the App Store, these Terms are between you and MACRODARK LLC, not Apple. Apple has no obligation to provide maintenance or support for Draskan. To the extent a warranty applies and Draskan fails to conform to it, you may notify Apple, and Apple may refund any amount you paid Apple for the app (if any); to the maximum extent the law allows, Apple has no other warranty obligation. The monthly subscription is paid to MACRODARK LLC on the web, not to Apple, and any refund of that subscription is handled under section 5 of these Terms, not by Apple.
Apple is not responsible for claims by you or a third party relating to Draskan or to your use of it, including product-liability claims, claims that Draskan fails to conform to a legal or regulatory requirement, claims under consumer-protection or privacy law, and claims that Draskan infringes intellectual property. You and we acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of this section, and that Apple may enforce it.
You represent that you are not located in a country subject to a U.S. government embargo, and that you are not on a U.S. government list of prohibited or restricted parties.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. If a court finds a part of these Terms unenforceable, the rest still applies.
